Protected Person application
Canada has an Immigration and Refugee Board (IRB), and a Citizenship and Immigration (CIC) department. Both these departments can decide if an applicant is a Protected Person. Applicant is a Protected Person if the IRB decides that you need protection, or if you are a “Convention Refugee”. Applicant may also be a Protected Person if CIC has approved your Pre-Removal Risk Assessment. A Protected Person can apply for permanent residence, based on application requirements.
Protected Person may also apply for permanent residence with this application if he/she is a member of the Protected Temporary Residents Class (PTRC). Protected Temporary Residents are individuals admitted to Canada on a temporary resident permit and have been determined to be in critical need of protection by a visa office.
ELIGIBLE TO APPLY FOR PERMANENT RESIDENCE AS A PROTECTED PERSON
Under a Protected Person or a Protected Temporary Resident application, the IRB or CIC determines the following eligibility for applicant:
A Convention refugee in another country where applicant could go and live permanently without fear of persecution;
A citizen, national or permanent resident of a country, other than the one applicant left, where applicant could go and live permanently without fear of persecution; or
A permanent resident of Canada.
APPLICATION FOR PERMANENT RESIDENCY
A Protected Person may apply for permanent residence any time after being notified by the Immigration and Refugee Board (IRB) or by CIC that the persons is/are a Protected Person, unless they have been named as a Designated Foreign National (DFN).
